Definitions of terms

  1. "University" means University of La Verne.
  2. Student includes all undergraduate students at the main campus of the University of La Verne.
  3. "University official" includes any persons employed by the University, performing assigned administrative or professional responsibilities.
  4. "Member of the University community" includes any person who is a student, faculty, administrator, staff, University official or any other person enrolled or employed by the University.
  5. "University premises" includes all land, buildings, facilities, and other property in the possession of, or owned, used, or controlled by the University.
  6. "Student organization" means any group of students recognized or registered by the University (academic or student life).
  7. "Judicial Review Body" means any person or persons authorized by the Associate Dean of Student Affairs to determine whether a student is responsible for violation of a University policy, to recommend imposition of sanctions, and to hear appeals.
  8. "Shall" is used in the imperative sense.
  9. "May" is used in the permissive sense.
  10. "Policy" is defined as the written regulations of the University as found in, but not limited to, the University Catalog, the Student Handbook - the Day to Day, the Guide to Residential Life, Class Schedule Booklet, Discipline Handbook, and other official publications.

Interpretation

The policies, procedures, and University regulations are provided to give students general notice of prohibited conduct. The policies, procedures, and University regulations should be read broadly and are not designed to define misconduct in exhaustive terms.

Jurisdiction

ULV jurisdiction and discipline shall be limited to conduct which occurs on the University premises or at academic sponsored programs or events which may include but not be limited to: practicums, internships, student field trips, student teaching, and independent study settings.
If a student is charged with an off-campus violation of federal, state, or local laws involving another student, faculty or staff as the victim, disciplinary action may be taken and sanctions imposed for grave misconduct which demonstrates flagrant disregard for the educational process or the health, safety and well-being of members of the University.

In such cases, no sanction may be imposed unless the student has been found guilty in a court of law or has declined to contest such charges, although not actually admitting guilt (e.g., "no contest" or "nolo contendere"). However, the Dean of Student Affairs or his/her designee may separate a student for an interim period, pending proceedings under this policy, whenever there is evidence that the continued presence of the student at the University poses a significant threat to the safety of the student or others or a substantial interference with the rights of others to continue normal and lawful University functions and activities.
